Your trust legal department – What do they do and how they can help
Adam is a solicitor who has specialised for over 25 years in defending doctors and other healthcare professionals before their regulators and in criminal matters.
This has involved him in a number of significant GMC/MPTS hearings, as well as criminal cases involving allegations of gross negligence manslaughter and sexual assault. He also advises doctors in respect of internal trust investigations under "MHPS" and DBS matters.
Additionally, Adam has represented doctors at inquests throughout his career and since 2019 has sat part time as an Assistant Coroner in two jurisdictions.
Adam has been ranked for "Professional Discipline" for some years in Chambers & Partners" (Band 2) and is recognised as a "Leading Individual" in professional discipline by "The Legal 500".
Will is a partner at Browne Jacobson LLP. With over 15 years in the profession, he is an expert litigator and master tactician specialising in the defence of clinical negligence claims. In this role he leads a team of senior litigators and is a trusted advisor to various leading organisations in the field, including NHS Resolution, NHS Trusts, and other private insurers and commercial organisations.
When it comes to his area of specialism, Will’s extensive experience covers the full spectrum of clinical negligence litigation covering numerous areas of medicine and law alike. He uses his experience, insight, and empathy to skilfully guide his clients to ensure the best outcomes are achieved. Will’s reputation in the field means he is regularly instructed on cases involving new and evolving issues of law of particular strategic importance.
Will also uses his understanding of the patient journey and empathy to deal with cases sensitively. He is a keen advocate for alternative approaches to claims resolution, and this has garnered him significant respect from leading claimant solicitors.
Outside of his case work, Will has a passion for helping clients and others learn, develop and grow. He is an accomplished speaker on the national and international stage, with a talent for distilling complex concepts down into easily accessible and engaging content. With this in mind, Will heads Browne Jacobson’s internal and external client-facing clinical negligence training programme and is a specialist in training on complex quantum and learning from harm, regularly delivering sessions focussed on these areas.
Will’s commitment to improvement and learning extends beyond the law around clinical negligence and into leading national healthcare improvement projects, such that he regularly contributes to national risk management initiatives for the NHS. This includes GIRFT and working with the BOA as a trusted medico-legal advisor.
Mr Nikhil Shah is a fellowship-trained consultant and works at Wrightington hospital with an interest in complex primary and revision hip and knee replacement surgery, periprosthetic fractures, pelvic discontinuity and custom acetabular reconstructions. His specialist trauma practice includes the management of pelvic-acetabular injuries. He completed his fellowships at Wrightington and the Holland institute (Sunnybrook and Women’s, Toronto). He has won several awards. Mr Shah teaches on various courses nationally and abroad. His research interests have revolved around his clinical work. His medicolegal practice deals with personal injury and clinical negligence in areas relevant to his routine and specialist practice.
